The National Intellectual Property Administration has recently issued a notice inviting public opinions on the "Revision Draft of Patent Examination Guidelines (Draft for Comment),” with feedback open until June 15.
The revision draft of the Guidelines covers various aspects of patent applications and examinations, including inventor information filing requirements, priority claims, definition of plant varieties, handling of same-day applications, examination of inventiveness, review of AI-related applications, and examination of bit stream invention patent applications.
The specific revision contents include requiring all inventors to provide information, clarifying priority claims in divisional applications, removing the definition of plants while establishing the definition of plant varieties, requiring abandonment of utility model rights for same-day applications in order to obtain invention patent rights, clarifying technical feature contributions in inventiveness examinations, mandating AI-related applications to comply with Article 5 of the Patent Law, and requiring bit stream applications to disclose encoding/decoding methods.
